Arbitration award, 22 Dec 23 George II (1749): by Edward Gibson, gent of Whitehaven, John Christian, gent of Cockermouth and Thomas Benson, gent of Egremont. Dispute between John Viccars of Taythes, yeoman, and Thomas Hartley of Church-house in Eskdale, yeoman, concerning their common rights on Slightside.
The decision: T.H. has an uncontestable right to common of sheep pasture, or sheep heath, on Slightside at all times of year in respect of his two tenements Church-house and Bridge End, without stint or number, which he & his heirs should continue to enjoy. J.V. also has the same rights on Slightside "in respect of his two tenements called the Taythes in Eskdale aforesd. And likewise that the owner of the Tenement called Bird-How in Eskdale aforesd. now the estate of Thomas Towers son-in-law of the sd. John Viccars has such and the like right of common upon Slightside". The boundary of the whole common is: beginning at the south corner of the Gray Stone, east to Horn Crag (aka Orn Crag), then to the Stone Cove Band, then north to the Long Green adjoining the mountain called Skottfield, then west to the Long Gill Head, then west to the Great Stone then south-west to "the Hollows or Doupes called Green Doup or Hollow Doup" then south to the Gray Stone (total c272 acres). This area is to be divided in 2/5 and 3/5 by the surveyor Mr John Stable, with mere-stones, beginning half-way between the Great Stone and the Grey Stone, then going east to the top (Hartley's heaf to NW, Viccars to SE). 10s damages payable for incursions- but injured party is not barred from claiming more if greater damage has been caused.

Also: arbitration bond, dated 31 Jul 1749: between J.V. & T.H., in £500.
